New Hampshire Child Custody Laws
New Hampshire child custody is presumed to be joint legal custody (joint responsibility for all parental rights and decisions); i.e. it is presumed that it is in the best interests of the child that both parents share custody, unless there has been misconduct towards the child by one of the parents. a New Hampshire Court will award child custody based upon the best interests of the child. In determining best interests, the Court will consider:

preference of the child;

the education of the child;

any findings or recommendations of a neutral mediator; and

any other factors.
